1. Acceptance of Terms

By accessing or using fima.mt (the “Site”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree with any part of the Terms, you must not use the Site.

2. About FIMA

The Fintech Institutions Malta Association (“FIMA”, “we”, “our”, or “us”) is a non‑profit membership organisation incorporated in Malta. The Site provides information about FIMA, its members, events, publications, and other industry‑related resources. Unless expressly stated, material on the Site is provided for general information only and does not constitute professional or legal advice.

3. Eligibility & User Conduct

You must be at least 18 years old and have the legal capacity to enter into binding agreements under Maltese law to use the Site.2. You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation;
  • Infringe or violate our intellectual‑property rights or those of any third party;
  • Upload or transmit viruses, malware, or any malicious code;
  • Collect data from the Site by automated means without our prior written consent;
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

4. Job & Career Listings

The "Careers" section aggregates vacancies posted by FIMA member companies. Listings are provided “as is” for informational purposes. FIMA does not:

  • Endorse or recommend any listed employer or position;
  • Vet, verify, or guarantee the accuracy of job descriptions, employment terms, or employer representations;
  • Participate in recruitment or employment decisions.Applicants should conduct their own due diligence before engaging with any employer.

5. Intellectual Property

Unless otherwise indicated, all content on the Site - including text, graphics, logos, downloads, stock photographs, and the overall page design - is either owned by FIMA or used under valid licence from a third‑party provider.

You may view, download, and print materials from the Site for your personal, non‑commercial use provided that you:

  • Retain all copyright, trademark, and proprietary notices;
  • Do not modify the materials;
  • Do not reproduce, distribute, or exploit the materials (including any licensed stock images) for commercial purposes without the prior written consent of FIMA or the relevant rights‑holder.

Note on stock photos: Images displayed on the Site may be licensed from third‑party image libraries (e.g., Shutterstock, iStock). Those licences do not permit visitors to extract, copy, redistribute, or use the images outside the context of this Site. Any unauthorised use could infringe the rights of the original licensors and may expose you to legal liability.

6. Third‑Party Links & Resources

The Site may contain links to external websites or resources that are not controlled by FIMA. We are not responsible for the content, privacy practices, or availability of such third‑party sites. Linking does not imply endorsement.

7. Disclaimer of Warranties

The Site and all content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, FIMA disclaims all warranties, express or implied, including but not limited to warranties of accuracy, reliability, non‑infringement, fitness for a particular purpose, and uninterrupted access.

8. Limitation of Liability

To the maximum extent permitted by law, FIMA, its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or related to your use of, or inability to use, the Site.

9. Indemnity

You agree to indemnify, defend, and hold harmless FIMA and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with your breach of these Terms or your misuse of the Site.

10. Changes to the Terms

We may amend these Terms at any time. Updated versions will be posted on this page with a new “Last updated” date. Continued use of the Site after changes become effective constitutes your acceptance of the revised Terms.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of Malta. You agree to submit to the exclusive jurisdiction of the Maltese courts to resolve any dispute arising from or related to these Terms or your use of the Site.

Fintech Institutions Malta Association (“FIMA,” “we,” “us,” or “our”) respects your privacy and is committed to protecting your personal data in line with the EU General Data Protection Regulation (Regulation (EU) 2016/679 – “GDPR”) and Maltese data‑protection laws.

1. Who We Are - Data Controller

FIMA is the data controller for personal data collected through fima.mt and any related sub‑domains (the “Site”).

2. Personal Data We Collect

Depending on how you interact with the Site, we may collect and process the following categories of personal data:

  • Identity and contact information – for example your name, organisation, job title, postal address, email address and telephone number. We obtain this when you complete a contact form, submit a membership application, register for an event, or otherwise correspond with us.
  • Membership information – such as licensing details, regulatory status, billing contacts and payment records. We collect these through our secure membership portal and during onboarding procedures.
  • Usage and technical information – including your IP address, browser type and version, device identifiers, pages visited, time spent on each page and referring URLs. This data is gathered automatically via cookies, server log files and analytics scripts to help us operate and improve the Site.
  • Marketing preferences – your choices about receiving newsletters or other communications from us. We record these when you tick an opt‑in box, manage your subscription settings, or use an unsubscribe link.
  • Recruitment information – such as curriculum vitae, cover letters and interview notes if you apply for a role at FIMA. We receive this directly from you or, where applicable, from recruitment partners.

We do not intentionally collect special‑category data (e.g., health information, biometric data or political opinions) through the Site.

3. Legal Bases for Processing

Under Article 6 GDPR, we rely on:

  1. Consent – where you opt‑in to newsletters, cookies, or specific event mailings.
  2. Contractual necessity – to administer your membership.
  3. Legal obligation – to comply with tax, reporting, or regulatory duties.
  4. Legitimate interests – to operate, secure, and improve the Site, and to promote FIMA’s objectives, provided your rights do not override our interests.

Where we rely on consent, you may withdraw it at any time (see Section 9).

4. Legal Bases for Processing

  • Member & Partner Management – processing applications, billing, and portal access.
  • Communication – responding to enquiries, sending updates, newsletters, and industry insights.
  • Events & Training – organising registrations, issuing tickets, and collecting feedback.
  • Careers – evaluating candidates for roles within FIMA.
  • Site Operation & Analytics – running the Site, diagnosing problems, improving content, and ensuring security.
  • Compliance & Risk – fulfilling audit, regulatory, and anti‑fraud obligations.

We do not use personal data for automated decision‑making or profiling that produces legal or similarly significant effects on you.

5. Sharing Your Data

We only share personal data when necessary and with appropriate safeguards:

  1. Service Providers – IT hosting, email delivery, payment processors, event platforms, who act as processors under written contracts.
  2. Regulators & Law‑Enforcement – where required by law or to protect our rights.
  3. FIMA Members – limited contact details may be shared within the closed membership directory (visible only to logged‑in members).

We never sell your data.

6. International Transfers

FIMA ordinarily stores data in the European Economic Area (EEA). Where data is transferred outside the EEA, we will ensure an adequate level of protection, e.g., by using Standard Contractual Clauses or transferring to jurisdictions covered by an adequacy decision under Article 45 GDPR.

7. Data Retention

We retain personal data only for as long as necessary:

  • Membership records: 6 years after end of membership (for accounting/legal purposes).
  • Event attendee data: 18 months after the event.
  • Newsletter contacts: until you unsubscribe
  • Job‑applicant data: 12 months after final decision unless you consent to longer retention.

We periodically review and securely erase or anonymise data that is no longer required.

8. Security

We may update this Privacy Policy to reflect changes in law or our practices. Material changes will be highlighted on this page and, where appropriate, notified to you by email.
